Atelier35 inc. (“Atelier35”, "we," "us" or "our") provides this privacy policy (“Privacy Policy”) to inform you (“User” or “Users” or “you”, which includes any user of the Services affiliated, employed or otherwise contracted by User) of our policies and procedures regarding the collection, use and disclosure of personal information and data we receive from Users using Atelier35's website, products and services (the “Services”). This Privacy Policy applies to any and all persons using the Services.

 

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meaning as in our Terms of Use. Be sure to return to this page periodically to review the most current version of the Privacy Policy. We reserve the right at any time, at our sole discretion and without any liability whatsoever, to change or otherwise modify the Privacy Policy without prior notice, and your continued access or use of the Services signifies your acceptance of the updated or modified Privacy Policy. If we modify it, we will update the "Last Updated" date at the top of the Privacy Policy. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Privacy Policy. PERSONAL INFORMATION COLLECTION AND USE

 

We collect information you provide directly to us, such as when you create or modify your account, request on-demand services, contact customer support, or otherwise communicate with us. This information may include: name, email and other information you choose to provide.

 

Personal information: To use the Services, you must first provide personal information that will allow you to be identified ("Personal Information"). This type of information will not be collected without your consent, and we expressly acknowledge that we will not use your Personal Information for any other purposes than those mentioned below without your consent. For certain portions of the Services, such as for the creation of an account, we shall collect Personal Information that you voluntarily upload or provide us through your use of the Services, such as your name and email address.

 

We may obtain Personal Information from other third parties regarding you, such as when you register with such a party to participate in one of such party’s services offered via such party’s website or mobile app, or through our Services. We may automatically import some of the Personal Information you provide to such third party into your account for the use of our Services.

Additionally, Personal Information may be used and disclosed to the extent Atelier35 may deem reasonably necessary to enforce the terms of any agreement between you and Atelier35, or if required by law, specifically in response to a demand from government authorities.



 

COLLECTION AND USE OF NON-PERSONAL INFORMATION

 

Upon accessing and when using the Services, certain non-personal information will be automatically collected, such as:

  • aggregated usage data;

  • tate and time you access the Services;

  • type of device you use;

  • information pertaining to your device and location data;

  • sensitive or confidential data, including, including but not limited to, customer lists, information on customers, technical and technological information, operational process, data pertaining to your product or businesses, and product design.

We use Non-Personal Information to examine our traffic, to review the use of our Services, to monitor and analyze use of the Services, to monitor and analyze the statistics, to get an accurate representation for technical administration, to increase our functionality and user-friendliness, and to better tailor our Services to our Users' needs.

DATA BREACH

Should a data breach that could cause risk to the rights of the Users, Atelier35 will inform you within 72 hours after having been informed of such a violation to the email address used to connect to our Services.


 

CHILDREN’S PRIVACY

 

We limit the use of Services to individual to the age of 16 and above. We do not knowingly collect, maintain, or use Personal Information and perform Services from children under the age of 16.

 

 

RIGHT TO EXAMINE INFORMATION

 

You have the right to examine any of your Personal Information that we collect. Should you wish to examine such information, please send us a written request to contact@atelier35.ca. Upon reception, Atelier35 will send you, under a reasonable delay, data in an electronic format.

 

In certain cases we may not be able to provide you with access to all of your Personal Information (ex: if the information also pertains to the Personal Information of another User).


 

WITHDRAWAL OF CONSENT

 

You may withdraw your consent to the collection of Personal Information at any time by sending a written request to contact@atelier35.ca. Upon receiving notice that you have revoked your consent, we will stop collecting and using your Personal Information within a reasonable time, which will vary depending on what information we have collected and for what purpose. Note that we will send you a confirmation email upon reception of your request. If you chose to withdraw your consent, your experience of the use of the Services may not be optimal.

 

RIGHT TO BE FORGOTTEN

 

You may decide at any time that your personal data be deleted once you cease to use the Services or once you decide that your Personal data stop being collected. Atelier35 commits to delete these data in a reasonable delay upon reception of a written request sent to contact@atelier35.ca

 

PROMOTIONAL COMMUNICATIONS

 

You may opt out of receiving promotional messages from us by following the instructions provided in these messages. If you unsubscribe, we may always send you non-promotional communications, such as regarding your account, or Services you might have requested, or business relations in progress.

 

SHARING INFORMATION

We will not sell, rent or disclose to outside parties the information we collect, save and except that we may share the collected information with other parties as follows:

  • Service Providers: We have agreements with various service providers to facilitate the rendering of our Services. All administrative service providers that we use are required to have the same level of privacy protection as we have, and therefore we expect that your information will be handled with the same level of care that we employ.

  • Statistical Analysis: We may share Non-Personal Information and aggregated anonymized information with third parties, including but not limited to, for statistical, machine learning, advertising or marketing purposes. No Personal Information will be shared in this manner.

  • Transactions: In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where Personal Information may be disclosed or transferred as one of our business assets. However, under no circumstances will such transactions result in your information being used for other purposes than those for which you gave us your consent

Atelier35 employs other companies and/or individuals to perform functions on our behalf. For instance, we may appoint third parties to develop software applications and/or databases functions or to send communications on our behalf. Your Personal Information may be disclosed to such individuals in the course of Atelier35’s business operations. All of Atelier35’s employees, agents, affiliates and contractors who have access to your Personal Information are required to protect the information in a manner that is consistent with this Privacy Policy.

INTERNATIONAL TRANSFER

 

Data collected within the European Economic Area (“EEA”) may be transferred to other countries outside the EEA for the reasons described in the present Privacy Policy.

This Privacy Policy is incorporated into and forms part of our Terms of Use, which outlines the terms and conditions you agree to when using the Services, and which can be found at the bottom most the pages of Atelier35’s websites.
